What Is an IME?

An IME is a medical examination requested by the insurance carrier and conducted by a doctor of their choosing. Despite the word “independent” in the name, the examining physician is paid by the insurance company. Their job is to provide a medical opinion that the carrier can use in evaluating your claim. That opinion may be used to dispute the severity of your injury, to argue that you have reached Maximum Medical Improvement, or to justify cutting off your benefits.

You Are Required to Attend

Under Florida law, you are required to submit to an IME if the insurance carrier requests one. Refusing to attend can result in the suspension of your benefits. If you receive an IME notice, take it seriously.

What Happens During the Examination

The exam is usually brief, sometimes lasting only a few minutes. The doctor will review your medical records and conduct a physical examination. They may ask you questions about how the injury occurred, your symptoms, your medical history, and your daily activities. Answer honestly but carefully. Avoid minimizing your symptoms or overstating what you can and cannot do.

The IME Report Can Be Challenged

Just because an IME doctor says your injury is minor or that you are ready to return to work does not mean the case is closed. Your own treating physician can provide a counter-opinion, and your attorney can challenge the IME findings through the formal dispute resolution process in Florida. What to Do Before Your IME

Tell your attorney about the appointment immediately. Bring a list of your current medications and a written summary of your symptoms and limitations. Do not exaggerate, but do not downplay either. Be consistent with what you have already told your treating doctors.
